TERMS OF PURCHASE:
 
These Terms govern the use of www.aerovionics.com and the purchase of listed products.
 
INTRODUCTION:
 
Training Solutions is a business registered in Poland with its office located at ul. Meksykańska 8/77, 03-948 Warsaw. It is registered under the REGON number 141785300 and has the NIP number 1132409933.
 
CUSTOMER DATA AND OBLIGATIONS:
 
Any information or personal data given to us by the customer will be handled following the specific privacy policies outlined for each online form. By utilizing our website, the customer agrees to process their data and confirms that the information provided is accurate and truthful. As such, the customer agrees to the following terms:
 
  1. Please use this website to submit only lawful inquiries or place orders.
  2. It is important that you do not place false or unfair orders. In the event of forgery or fraud, Aerovionics is entitled to cancel the order and inform the relevant authorities. Please note that Aerovionics does not accept any liability for any damages and/or expenses that may arise from such actions. 
  3. When providing Aerovionics with your contact information, please ensure that it is truthful and accurate. Aerovionics may use this information to contact you as needed. 
  4. To use our services, you must be over 18 years old and have the legal capacity to enter into contracts. Aerovionics may verify compliance with this requirement by any means it deems appropriate. Thank you for your cooperation.
 
 
AVAILABILITY OF AEROVIONICS SERVICES AND PRODUCTS:
 
Our website provides Aerovionics products that are available in the EU. However, please note that Aerovionics reserves the right to refuse or cancel orders if necessary. Additionally, all orders are subject to product availability. If any delivery difficulties or out-of-stock issues occur, we will promptly notify the customer via email and provide a full refund for any payments made.
 
 
 
ORDERS:
 
How are orders placed?
To place an order, customers should follow the online purchase process and click on the "CONFIRM ORDER" button. Within 24 hours of placing the order, customers will receive an email confirming receipt of their order (known as the "Order Confirmation"). Once the order has been shipped, customers will receive a second email notifying them of the shipment (known as the „Shipment Confirmation"). If customers realize they've made a mistake in the information they provided, they can reach out to our Customer Service Department at info@aerovionics.com
 
How are shipments and deliveries made?
After the Customer completes their payment, Aerovionics will prompt them to choose a shipping method for their order. The shipping cost will depend on the selected method and will be automatically calculated during the payment process before the order is finalized. Please note that the production of some products may take approximately up to 2 to 4 weeks. The estimated delivery time for orders is 3 to 5 full business days. Business days are defined as Monday through Friday, excluding official holidays.
 
Can Aerovionics cancel an order?
At Aerovionics, we reserve the right to cancel any order, even after prior acceptance, without being liable for any damages or expenses. This may occur in the following cases:
 
1. If an inadvertent error occurs in the online store, such as a payment or inventory error.
 
2. If we have reason to believe that the customer is a minor or that the credit card used does not meet the requirements described in our terms.
 
3. If the payment details provided by the customer are incorrect or impossible to verify.
 
4. If the delivery address provided by the customer is outside our territory or if we are unable to deliver to the address provided.
 
If we detect any of these cases, we will notify you via email to resolve the issue before taking any action.
 
PRODUCT NON-COMPATIBILITY:
 
Once the order is received, the customer should check the status of the order. In the event of any defects or nonconformity, the customer may choose to either return the product for a full refund, including any shipping costs that may have been paid or exchange it for a new product in good condition at no extra cost within 14 days.
 
EXCHANGES AND RETURNS:
 
If the Customer is not satisfied with their purchase from www.aerovionics.com, they have 14 calendar days from the date of delivery to return the product. Aerovionics will provide a full refund for the product price using the same payment method as the initial transaction. The refund will be issued within 7 calendar days of Aerovionics receiving the returned product, but shipping and return costs will not be refunded unless the product was delivered in error or has a defect. To initiate a return, the Customer should send an email to info@aerovionics.com with the subject "Return" to request the return form and address details. The Customer is responsible for the direct costs of returning the product and it must be in its original packaging and perfect condition. The time it takes for the refund to appear in the Customer's account depends on their bank.
 
The Customer also has the right to withdraw from the contract within 14 calendar days of the product's delivery, provided they provide a reason. To exercise this right, the Customer must notify Aerovionics by sending an email to info@aerovionics.com with the subject "Return" expressing their desire to withdraw from the contract and receive the necessary form and address details. If the Customer withdraws from the contract, Aerovionics will refund all payments received for the purchase, including shipping costs (except for additional costs resulting from the Customer's delivery method choice), within 14 calendar days of receiving the decision to withdraw. The refund will be processed using the original payment method unless otherwise requested. The Customer must return the product within 14 calendar days of notifying Aerovionics of their decision to withdraw from the contract, and any reduction in the product's value resulting from handling beyond what is necessary to establish its nature, properties, or functioning will be the Customer's responsibility. The return is also the Customer's responsibility and at their expense, with confirmation of purchase required.
 
PURCHASE AS A GUEST:
 
On the Aerovionics website, you can also shop without creating an account. This guest shopping option only requires you to provide the information needed to process your order. After completing your purchase, you can choose to register as a user or continue shopping as a guest.
 
PRICES AND TAXES:
 
The prices of products displayed on our website are accurate at the time of purchase. However, please note that prices are subject to change without prior notice. Rest assured that any orders that have already been accepted will not be affected by these changes. The total price of each order includes product prices, shipping costs, and other applicable service taxes. Shipping costs will be added to every order. Aerovionics will always inform you of the total price, including taxes and other costs like fees and delivery expenses at checkout, after the shipping details are entered. Please note that orders shipped to a different customs union are exempted from VAT. In this case, local customs duties, taxes and additional fees may be charged upon delivery. The payment of these charges are the sole responsibility of the customer. We allow our customers to choose between receiving electronic or paper invoices. If you opt for a paper invoice, we will issue and send it to you in this format.
 
 
PAYMENT METHODS:
 
Aerovionics accepts credit cards by PayU, PayPal transactions and payment via bank transfer in Polish Zloty (PLN) or Euro (EUR). If you choose to use any other payment method, Aerovionics is not responsible for any loss of payment or damages resulting from the Customer's actions.
 
FAKE WARNING:
 
Aerovionics products can only be purchased through their official website at www.aerovionics.com, buyers should be wary of unauthorized channels.

OBLIGATIONS:
 
At Aerovionics, we guarantee the quality of the services purchased through our Online Store. We assure our customers that all rights granted by applicable regulations to consumers and users will be implemented. In case of non-compliance with any of these terms, the customer may request the return of products or the cancellation of services.
 
WARRANTIES:
Aerovionics has a responsibility to ensure that deliveries are compliant with applicable regulations. If there is any lack of compliance, Aerovionics will be liable to the Customer for two years. However, any damage caused by use or misuse, as well as any provisions excluded under applicable law, are not covered by the warranty.
 
 
LIABILITY AND INDEMNIFICATION:
 
Aerovionics is responsible for the purchase price of any product bought on their website unless stated otherwise in the Terms and Conditions. All information, images, and materials on the website are provided without any express or implied warranty, except for those required by law. The 3D computer visualizations of advertisements may differ slightly from reality. Some products may appear larger or smaller than their actual size due to screen settings or photography methods. The customer is responsible for verifying the product's description and dimensions. Once the customer has signed the contract, Aerovionics is obligated to deliver the products as agreed and is liable for any defects or non-conformity at the time of delivery. The color shades in product photos on the website may vary depending on the monitor resolution and slightly from the actual colors. Natural materials used in our products may have variations in colors, sizes, and textures, which are not considered defects or errors.
 
HIGHER POWER:
 
Aerovionics cannot be held responsible for any failure or delay in fulfilling its obligations if it is caused by events beyond its control (known as "Force Majeure"). These events might include strikes, riots, natural disasters, or government regulations. During a Force Majeure event, Aerovionics' obligations will be suspended, and the deadline for fulfilling them will be extended for a period equal to the duration of the event. Aerovionics will make every effort to end the event or find a solution that allows it to fulfill its obligations despite the event.
 
 
INDUSTRIAL AND INTELLECTUAL PROPERTY:
 
The Client acknowledges that Aerovionics or licensed persons own all website content's copyrights, registered trademarks, and industrial and intellectual property rights.
 
WRITTEN COMMUNICATION:
 
In adherence to regulations, Aerovionics may need to provide certain information or messages in writing. By using this website, customers agree that Aerovionics will mostly communicate with them electronically via email or website postings. Customers consent to this electronic form of communication for contractual purposes and acknowledge that it meets legal requirements for written communication.
 
TRANSFER OF RIGHTS AND OBLIGATIONS:
 
Both the Customer and Aerovionics are bound by the Agreement, as well as their respective successors, beneficiaries, and assigns. The Customer cannot transfer, assign, charge, or otherwise transfer the contract or any rights or obligations without Aerovionics' prior written consent. However, we may transfer, assign, charge, or otherwise transfer the contract or any rights or obligations at any time during its term without affecting the Customer’s rights.
 
WAIVER:
 
If the Customer fails to fulfill any of their obligations under the Agreement or these Terms, Aerovionics will not waive or limit its rights or actions, nor release the Customer from their obligations. Any waiver by Aerovionics of a specific right or action does not constitute a waiver of any other right or action under the Agreement or the Terms. Aerovionics will only waive these Terms or any rights or actions in writing and if it is expressly stated as a waiver and communicated to the Customer as provided in the Agreement.
 
 
ENTIRE AGREEMENT AND PARTIAL INVALIDITY:
 
The agreement between Customer and Aerovionics is detailed in these Terms, along with any other accompanying documents. This agreement supersedes any prior promises, obligations, or understandings between the two written or verbal parties, whether. Both Customer and Aerovionics acknowledge that they are entering into this agreement without relying on any prior representations or promises made by the other party unless specifically stated in these Terms. Neither Customer nor Aerovionics can take legal action against the other for any misrepresentations made before the contract's conclusion unless they were fraudulent. In the event of a breach of the contract, the party affected will take action as outlined in these Terms and Conditions. If any of the provisions of these Terms or the contract are deemed invalid by a competent authority, the remaining provisions will still be in effect.
 
CHANGES TO THE TERMS AND CONDITIONS:
 
Aerovionics may update these Terms at any time. You are bound by the policies and Conditions in place when using the website or placing an order.
 
LANGUAGE, APPLICABLE LAWS AND JURISDICTION:
 
The official languages used for the contract between Aerovionics and the Customer are Polish and English. When using our website and purchasing products through contracts on the website, Polish law applies. Any disputes related to the website or mentioned contracts will be resolved in the courts and tribunals of the Customer's domicile/registered office. If consumers have any purchase claims, they can use the online redressal platform provided by the European Commission at the following link: http://ec.europa.eu/consumers/odr/
