To ensure clarity, we have provided definitions of key terms below:

 

Administrator: Training Solutions

 

User (including customer): A person who visits our website, registers an account, makes purchases, submits a complaint, receives ordered commercial information/direct marketing from us, or maintains correspondence with us.

 

Data recipient: Entities authorized to receive data under applicable laws or entities acting for Training Solutions.

 

Aeorvionics operates a website with the domain www.aerovionics.com, which is covered by this Privacy Policy.

 

    1. As the entity providing a given service or sale, Training Solutions is the administrator of personal data and decides how it will be used. If you have any doubts about identifying this entity, please refer to the regulations specifying the rules for the provision of this service or sale.

    2. We take the protection of processed personal data seriously and apply appropriate technical and organizational measures to ensure its safety. Personal data of our Users and other individuals whose data was reported by the Users are protected against unauthorized disclosure, loss, or modification.

    3. Entities operating for Training Solutions and responsible for operating websites in the domain www.aerovionics.com, as well as entities providing services in this respect to Aerovionics (e.g. entities providing internet delivery services, entities providing a server), may be recipients of personal data. Recipients may also include entities authorized to receive data under applicable law, including competent judicial authorities.

Article 2.

 

The basis, purpose, and duration of processing personal data:

 

  1. Providing personal data is optional, but it may hinder or prevent the proper performance of the service, sale, or provision of after-sales service if data is not provided.

  2. Personal data is essential for providing services at the highest level and their development. Therefore, Training Solutions takes all necessary measures to secure personal data, including processing it only on the basis of appropriate legal grounds. The scope of collected data depends strictly on the type of service provided, such as:

 

User account registration:

  • email address, user name, correspondence address, and phone number

 

Online shopping by registered users and online shopping without registration:

  • first name and last name, correspondence/shipping address, billing, email address, phone number, and username (required when registering an account)

 

Newsletter:

  • email address

 

Contact:

  • first name and last name, email address

 

Loyalty program:

  • in accordance with the program regulations

 

In addition, to improve the website's functionality, structure, and content to meet individual users' needs and maintain the website's quality and security, technology is used that collects and processes data stored in cookies, including the IP address (details described in Article 5 of the Privacy Policy).

3.  The following are the purposes and legal bases for processing personal data:

 

1. Registering an account on the website and verifying the user's identity for secure login. This is based on the user's acceptance of the terms of the regulations under Article 6(1)(b) of the RODO.

 

2. Taking action at the user's request before concluding the contract and implementing the sales and purchase contract, which includes handling payments, delivery, and providing information about the order status via SMS and/or email messages, as well as handling the complaint process. This is based on the acceptance of the store regulations website: www.aerovionics.com under Article 6(1)(b) of the RODO.

 

3. Making online purchases without registering a user account, including online payments, sending information about the order status via SMS and/or email messages, and handling the complaint process. This is also based on acceptance of the website regulations: www.aerovionics.com under Article 6(1)(b) of the RODO.

 

4. Fulfilling legal obligations of Training Solutions, particularly with regard to countering money laundering and terrorist financing under the AML Act, accounting and taxes, and for archiving purposes under Article 6(1)(c) of the RODO.

 

5. Send marketing content via a voluntary communication channel, such as email, to present commercial offers and personalized information about Aerovionics products and services. This is based on the legally justified interest of the administrator under Article 6(1)(f) of the RODO.

 

6. Communicating with the user and responding to messages sent via the contact form available on the website: www.aerovionisc.com, based on the legally justified interest of the administrator in building and developing relationships with users under Article 6(1)(f) of the RODO.

 

7. Adapting and developing the functionality of the websites, including their structures and content to the needs of users, creating edited statistics, and maintaining the security and quality of the services provided, all based on the legitimate interest of the administrator under Article 6(1)(f) of the GDPR.

 

8. Pursuing or securing claims, delivering the purchase to a third party (other than the buyer), or adapting and developing the websites: www.aerovionics.com, including their structure and content to the individual needs of the user and maintaining the security and quality of the services provided, all of which constitutes the legitimate interest of the administrator under Article 6(1)(f) of the RODO.

 

9. Protecting users' interests or clarifying the actual situation when considering disputes, irregularities, or abuses, as well as technical issues related to server administration (IP addresses collected during internet connections). Additionally, IP addresses are used to collect general, statistical information enabling, among other things, determination of the region from which the connection is made to determine the default language of the website interface and allowing for adapting marketing content to the user's individual preferences.

4. Personal data processing period.

 

The period for processing personal data depends on the specific purpose for which the data was collected. For registered users of the website www.aerovionics.com, personal data will be processed for as long as the individual remains a user. After this time, the data will be kept for as long as necessary to comply with legal obligations or to pursue or defend against any claims. If the data was collected for the purpose of implementing a purchase and sale agreement, it will be processed for 5 years from the end of the calendar year in which the purchase was made. Personal data collected for AML processes will be processed for 5 years from the first day of the year following the year in which transactions or economic relations with a given user ceased. 

 

In cases where a purchase is made online but not paid within 7 days of completing the purchase form available on www.aerovionics.com, the purchase will be canceled and the personal data indicated in the forms will be processed for the duration of defense or pursuit of any claims in accordance with applicable laws. Personal data collected from individuals who contact us via the contact form available on www.aerovionics.com will be processed for a period of 1 year from the end of the calendar year in which the contact occurred. 

 

Data collected for the purposes of sending marketing content will be processed until an objection is raised to the processing or until consent to the selected communication channel for which consent was given is withdrawn. Data collected for the purpose of adapting and developing the functionality of the website www.aerovionics.com will be processed until the user raises an objection or until it becomes outdated. If the processing is carried out based on the user's consent, the data will be processed until the purpose for which it was collected is achieved or until the consent is withdrawn, whichever occurs first.

5. The Administrator is allowed to use third-party data provided by Users in order to communicate, make recommendations, and provide services through the website www.aerovionics.com This includes the use of tools for contracting. By entering this data, the User confirms that they have received permission from the person whose data is being entered to make it available to the Administrator.

 

6. Users’ data may be shared with other Users if it is necessary to fulfill the terms of the contract.

Article 3:

 

Control of personal data processing:

 

  1. The Administrator ensures that persons whose personal data are processed exercise the rights arising from legal provisions, including the right to access their own personal data, rectify, change, delete, or transfer them, as well as the right to request the restriction of the processing of personal data and to object to such processing in accordance with the principles set out in applicable regulations.

  2. In the case of voluntary consent to data processing, each person whose data is processed has the right to withdraw consent to data processing.

  3. Each person whose data is processed has the right to lodge a complaint with the President of the Personal Data Protection Office.

 

Article 4:

 

Transferring and sharing personal data:

 

  1. Users' data may be made available to entities authorized to receive them under applicable law, including competent judicial authorities.

  2. Personal data may be transferred to Data Recipients who are service providers performing specific tasks on behalf of Training Solutions. These include entities that provide: technology-related services (e.g. website support, mobile applications), payment processing in the online store, and Courier services.

  3. Users' personal data may be transferred to third parties - in cases not indicated by the Administrator or legal provisions - only with the consent of the data subject.

  4. Personal data may be transferred to third countries (outside the European Union countries) in connection with the delivery of Products ordered by Users.

  • Analytical - called statistical - collects information about how often the website is visited and how it is used. This redacted and anonymous information is used to improve the content and performance of the site - this is not possible without consent. Stored on the device for up to 2 years.

  • Advertising - also called marketing - allows the display of advertisements tailored to the profile of the User visiting the website. Based on your browsing history, profiles are built and shared with advertising partners so that personalized ads are displayed on other websites. They are stored for a period of 1 year.

  1. Due to the time for which the cookie will be placed on the User's end device:

 

  • Session cookies - temporary, which remain in the User's browser memory until they leave the website www.aerovionics.com - they are mandatory for the proper operation of selected applications and the correct display of website content,

OBLIGATIONS:
 
At Aerovionics, we guarantee the quality of the services purchased through our Online Store. WARRANTIES:
 
Aerovionics has a responsibility to ensure that deliveries are compliant with applicable regulations. If there is any lack of compliance, Aerovionics will be liable to the Customer for two years. However, any damage caused by use or misuse, as well as any provisions excluded under applicable law, are not covered by the warranty.
LIABILITY AND INDEMNIFICATION:
 
Aerovionics is responsible for the purchase price of any product bought on their website unless stated otherwise in the Terms and Conditions. All information, images, and materials on the website are provided without any express or implied warranty, except for those required by law. The 3D computer visualizations of advertisements may differ slightly from reality. Some products may appear larger or smaller than their actual size due to screen settings or photography methods. The customer is responsible for verifying the product's description and dimensions. Once the customer has signed the contract, Aerovionics is obligated to deliver the products as agreed and is liable for any defects or non-conformity at the time of delivery. The color shades in product photos on the website may vary depending on the monitor resolution and slightly from the actual colors. Natural materials used in our products may have variations in colors, sizes, and textures, which are not considered defects or errors.
 
HIGHER POWER:
 
Aerovionics cannot be held responsible for any failure or delay in fulfilling its obligations if it is caused by events beyond its control (known as "Force Majeure"). These events might include strikes, riots, natural disasters, or government regulations. During a Force Majeure event, Aerovionics' obligations will be suspended, and the deadline for fulfilling them will be extended for a period equal to the duration of the event. Aerovionics will make every effort to end the event or find a solution that allows it to fulfill its obligations despite the event.
 
INDUSTRIAL AND INTELLECTUAL PROPERTY:
 
The Client acknowledges that Aerovionics or licensed persons own all website content's copyrights, registered trademarks, and industrial and intellectual property rights.
 
WRITTEN COMMUNICATION:
 
In adherence to regulations, Aerovionics may need to provide certain information or messages in writing. By using this website, customers agree that Aerovionics will mostly communicate with them electronically via email or website postings. Customers consent to this electronic form of communication for contractual purposes and acknowledge that it meets legal requirements for written communication.
 
TRANSFER OF RIGHTS AND OBLIGATIONS:
 
Both the Customer and Aerovionics are bound by the Agreement, as well as their respective successors, beneficiaries, and assigns. The Customer cannot transfer, assign, charge, or otherwise transfer the contract or any rights or obligations without Aerovionics' prior written consent. However, we may transfer, assign, charge, or otherwise transfer the contract or any rights or obligations at any time during its term without affecting the Customer’s rights.
 
WAIVER:
 
If the Customer fails to fulfill any of their obligations under the Agreement or these Terms, Aerovionics will not waive or limit its rights or actions, nor release the Customer from their obligations. Any waiver by Aerovionics of a specific right or action does not constitute a waiver of any other right or action under the Agreement or the Terms. Aerovionics will only waive these Terms or any rights or actions in writing and if it is expressly stated as a waiver and communicated to the Customer as provided in the Agreement.
 
ENTIRE AGREEMENT AND PARTIAL INVALIDITY:
 
The agreement between Customer and Aerovionics is detailed in these Terms, along with any other accompanying documents. This agreement supersedes any prior promises, obligations, or understandings between the two written or verbal parties, whether. Both Customer and Aerovionics acknowledge that they are entering into this agreement without relying on any prior representations or promises made by the other party unless specifically stated in these Terms. Neither Customer nor Aerovionics can take legal action against the other for any misrepresentations made before the contract's conclusion unless they were fraudulent. In the event of a breach of the contract, the party affected will take action as outlined in these Terms and Conditions. If any of the provisions of these Terms or the contract are deemed invalid by a competent authority, the remaining provisions will still be in effect.
 
CHANGES TO THE TERMS AND CONDITIONS:
 
Aerovionics may update these Terms at any time. You are bound by the policies and Conditions in place when using the website or placing an order.
 
LANGUAGE, APPLICABLE LAWS AND JURISDICTION:
 
The official languages used for the contract between Aerovionics and the Customer are Polish and English. When using our website and purchasing products through contracts on the website, Polish law applies. Any disputes related to the website or mentioned contracts will be resolved in the courts and tribunals of the Customer's domicile/registered office.
